Maisons Vaudésir - Terms and Conditions
By booking with us you confirm that you accept the following articles:
Article 1 - This short-term rental contract is reserved for the exclusive use of renting Maisons Vaudésir.
Article 2 - Duration of stay: The Guest signing this contract for a fixed rental period cannot under any circumstances claim any right to remain in the premises at the end of the stay.
Article 3 - Contract effective date: This contract becomes effective as soon as the Guest has paid for the reservation.
Article 4 - Authorized guests: This property has a maximum capacity of 4 people. If the number of Guests exceeds the capacity, the owner may refuse the additional people unless the reservation is modified (up to 4 adults). Any breach of contract or modification of the booking will be upon your initiative.
Article 5 - Prices: Our price per night includes all taxes. Prices confirmed when booking are always the correct prices.
Article 6 - Cancellation by the guest: Any cancellation must be notified by written message or e-mail to the owner.
Our cancellation policy is moderate:
a) cancellation before arrival at the premises: any cancellation made more than 5 days before arrival is fully refunded. Any cancellation made 5 days or less before arrival (4:00 p.m. check-in) is subject to a fee of 50% of the total cost of the reservation (the renter is refunded 50% of the total reservation amount).
If the Guest does not appear within 24 hours following the arrival date, this contract becomes null and void and the booked space is then free to be offered to other guests. You will not receive a refund.
Please contact us as soon as possible if something unexpected happens so that we can find a solution that works for both of us.
b) if the stay is shortened, the rental proceeds remain with the owner. No refunds will be made.
Article 7 - Cancellation by the owner prior to arrival: The owner reserves the right to cancel your booking in case of unexpected situations outside of our control. In the rare case this happens and we have no other choice but to cancel your booking we will offer you to change your booking to a later date, in the 12 months following your scheduled arrival date. Alternatively, we can offer a full refund. You can not claim any indemnity or compensation.
Article 8 - Arrival: The Guest must arrive on the specified day. Arrival time can be discussed with the owner.
Article 9 - Walk-through: A walk-through of the property takes place upon the Guest's arrival to document the property's state.
Article 10 - Security deposit: One day before the arrival of the Guest, a security deposit of €500 is pre-authorized. After the check-out walkthrough with the Guest, this deposit is returned, less the cost of restoring the premises if damage is noted (reimbursed at most 3 days following check-out). In the event of an early departure, preventing the check-out walkthrough, the security deposit (less any damages) is returned by the owner at most 3 days following the date of original check-out.
Article 11 - Use of the premises: The Guest must ensure the peaceful nature of the rental, use it in accordance with the purpose of the premises, maintain the rented accommodation and return it in good condition of cleanliness and repair at the end of the contract (if items in the inventory are broken or damaged, the owner may claim their replacement value).
The Guest needs to promptly notify the owner of any property issues requiring maintenance.
In the event that urgent repairs appear necessary during the rental, the Guest must let the owner carry them out.
It is specified that in the event of a breakdown or malfunction of household appliances, the Guest will under no circumstance be able to obtain compensation or a reduction in the rent from the owner; the same applies to all services not directly dependent on the owner (for example: internet access, cable TV, etc.)
Article 12 - Hot Tub: Guests are entitled to the use of the exterior Nordic-style hot tub if the amenity is included in their reserved rate and if the Hot Tub Terms and Conditions are signed and returned at least 48 hours prior to guest check-in (to allow for owners to adequately prepare the hot tub for guest use).
Article 13 - Responsibilities of the owner: the owner agrees to quickly resolve any maintenance or repair problem affecting the habitability of the property.
Article 14 - Quiet hours: avoid any noise or behavior, of your own making, of your family or of your guests, likely to disturb neighbors from 10:00 p.m. to 8:00 a.m.
Article 15 – Pets: Pets are not allowed at the property.
Article 16 – Smoking: Smoking is prohibited indoors. Smoking is only allowed outside.
Article 17 - Liability: The Guest agrees to indemnify and hold harmless the owner from any and all claims, demands, losses, liabilities, damages, and expenses (including attorney's fees) arising out of or resulting from the Guest's use or occupancy of the rental property, including but not limited to any injury, loss, or damage to persons or property caused by the Guest's negligence, intentional misconduct, or violation of any terms of this agreement. The owner shall not be liable for any loss or damage to the Guest's personal property during the rental period. The Guest is encouraged to obtain renter's insurance to protect against any such losses.
Article 18 – Automatic termination: in the event of failure by the Guest to fulfill one of the contractual obligations, this lease will be rightfully terminated. This termination will take effect 48 hours after a simple summons by registered letter or hand-delivered letter has remained unsuccessful.
Article 19 – Election of domicile: for the execution of these terms, the owner and the Guest elect domicile in their respective domiciles. However, in the event of a dispute, the court of the owner's domicile will have sole jurisdiction. This contract and its consequences are subject to French law.
